Welcome to NAZARE.
The terms “we”, “us” and “our” refer to NAZARE.
NAZARE operates this store and website, including all related information, content, features, tools, products and services, in order to provide you with a curated shopping experience (the “Services”).
Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced within them (collectively, the “Terms”), describe your rights and responsibilities when you access, browse or use the Services.
Please read these Terms carefully. They contain important information about your legal rights, including provisions relating to warranties, liability and dispute resolution.
By accessing, interacting with or using the Services, or by placing an order through our store, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms or our Privacy Policy, you should not use the Services.
Nothing in these Terms excludes, restricts or limits any consumer rights that cannot legally be excluded, restricted or limited under applicable law.
Section 1 — Access and Account
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province or country of residence, or that you have the permission of a parent or legal guardian where required.
To use certain parts of the Services, including purchasing products, you may be required to provide information such as your name, email address, billing information, payment information and shipping address.
You represent that the information you provide to us is accurate, current and complete and that you have the necessary right to provide that information.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
You may not sell, transfer, assign or license your account to another person.
Section 2 — Our Products
We make reasonable efforts to display and describe our products accurately.
However, colours and product appearance may vary depending on your screen, device, display settings, lighting and other factors.
Many NAZARE products are produced on demand after an order is placed and may be manufactured, printed, packed and shipped on our behalf by third-party fulfilment partners.
Because products are manufactured individually, minor variations in colour, positioning, print appearance or finish may occur within normal manufacturing tolerances.
Nothing in this section affects your statutory rights. Where applicable consumer law requires products to match their description, be of satisfactory quality, be fit for purpose or otherwise conform to the contract, those rights continue to apply.
Product descriptions, designs and availability may be updated from time to time.
We reserve the right to discontinue products or limit the quantities available to any person, geographic region or jurisdiction, subject to applicable law.
Section 3 — Orders
When you place an order, you are making an offer to purchase the products included in that order.
Your order is not accepted until we confirm acceptance.
Payment must be successfully authorised and processed before an order can be fulfilled.
Because many NAZARE products are produced on demand, orders may enter production shortly after they are placed.
Please review your order carefully before submitting it. We will make reasonable efforts to accommodate requested changes or cancellations, but we cannot guarantee that an order can be changed or cancelled after fulfilment has begun.
If we cannot accept an order, need to make a material change to it, or cancel it, we will attempt to contact you using the email address, billing information or other contact information supplied with the order.
Where an order is cancelled by us after payment has been taken, we will issue an appropriate refund.
Your purchases are also subject to our Returns & Refunds Policy.
Unless otherwise agreed, products purchased through the store are intended for personal or household use and not for commercial resale.
Section 4 — Prices and Billing
Prices, discounts and promotions may change without notice.
The price charged for a product will be the price displayed and applicable when your order is placed, subject to correction of genuine pricing errors where permitted by law.
Taxes will be included in or added to displayed prices as required by applicable law.
Shipping charges, customs duties, import taxes or other charges may apply depending on your location and will be disclosed or handled as required by applicable law.
Where customs duties or import charges are payable by the customer, this will be communicated where reasonably required before purchase.
Promotions may be subject to additional terms and conditions. If specific promotional terms conflict with these Terms in relation to that promotion, the promotional terms will apply.
You agree to provide accurate and current purchase, billing and payment information.
You represent that you are authorised to use the payment method supplied for your purchase.
Section 5 — Shipping and Delivery
Delivery dates and transit times displayed by us are estimates unless expressly stated otherwise.
Orders may be fulfilled and shipped from different locations depending on the product, customer destination and fulfilment facility.
We are not responsible for delays caused by circumstances outside our reasonable control, including carrier disruption, customs processing, severe weather, strikes, natural events or other external disruption.
However, nothing in this section limits any statutory rights you have regarding delivery times, delayed goods, lost goods or non-delivery.
We remain responsible for your order to the extent required by applicable consumer law.
Risk of loss or damage to products passes to you when the products are delivered to you, or to a person identified by you to take possession of them, except where applicable law provides otherwise.

Section 6 — Intellectual Property
The Services and their contents, including trademarks, brand names, logos, text, graphics, photographs, images, videos, audio, designs, product graphics, website design and other materials, are owned by or licensed to NAZARE and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use.
Unless expressly permitted by us or applicable law, you must not reproduce, copy, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, sell or commercially exploit materials from the Services without our prior written permission.
Nothing in these Terms grants you a licence or ownership right in any trademark, copyright, design or other intellectual property belonging to NAZARE, Shopify or any third party except as expressly stated.
NAZARE names, logos, product names, designs and slogans may constitute trademarks or other protected intellectual property and must not be used without permission.
Shopify's names, logos, products and services remain the property of Shopify or its licensors.
All other trademarks appearing through the Services belong to their respective owners.
Section 7 — Optional Tools
We may provide access to tools or functionality supplied by third parties.
We do not necessarily monitor or control those third-party tools.
Except where otherwise required by applicable law, third-party tools may be provided on an “as is” and “as available” basis.
Your use of third-party tools may also be subject to the relevant provider's own terms and privacy policies.
You should review those terms before using the relevant service.
We may add new features, tools or resources to the Services in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.

Section 9 — Relationship With Shopify
NAZARE is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are made directly between you and NAZARE.
Shopify is not the seller of NAZARE products and is not responsible for the performance of the contract of sale between you and NAZARE.
To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, losses or liabilities arising solely from products purchased from NAZARE or transactions entered into directly with NAZARE.
Nothing in this section affects any rights or remedies that cannot legally be excluded.
Section 10 — Privacy
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, Shopify also processes certain personal information in connection with your access to and use of the Services.
Information submitted through the Services may be shared with Shopify, fulfilment partners, payment providers, delivery providers and other third-party service providers where necessary to operate the store, fulfil orders, process payments and provide the Services.
Some service providers may process information in countries other than the country in which you live.

Section 11 — Feedback and Reviews
If you submit, upload, post, email or otherwise provide ideas, suggestions, feedback, reviews, photographs or other content relating to NAZARE or the Services (“Feedback”), you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, publish, distribute, adapt and display that Feedback for purposes connected with operating, improving and promoting NAZARE and the Services.

Nothing in this section affects your statutory consumer rights or any remedies that applicable law requires us to provide in connection with products you purchase.
Section 18 — Indemnification
To the extent permitted by applicable law, you agree to indemnify NAZARE and its affiliates, officers, directors, employees and service providers against third-party claims, liabilities, losses and reasonable costs arising directly from:

The remaining provisions will continue in effect.
